Terms of Service

1. Acceptance

By accessing or using ThinkTickle ("the Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

ThinkTickle provides real-time stock scanning, signal intelligence, pattern analysis, and related tools for informational and educational purposes. The Service is operated by ThinkTickle ("we," "us," or "our").

3. Not Financial Advice

Nothing on ThinkTickle constitutes financial, investment, trading, or any other form of professional advice. All content, signals, alerts, trade setups, scans, scores, forecasts, and analysis are for informational and educational purposes only.

You are solely responsible for your own investment decisions. Always do your own research and consult a licensed financial advisor before trading. Past performance shown is not indicative of future results. Trading involves substantial risk of loss, including potential loss of all capital.

4. Publisher Status (Investment Advisers Act §202(a)(11)(D))

ThinkTickle operates as the publisher of a bona fide publication of general and regular circulation under the publisher exclusion to the “investment adviser” definition in the Investment Advisers Act of 1940, codified at 15 U.S.C. §80b-2(a)(11)(D), as interpreted by the U.S. Supreme Court in Lowe v. SEC, 472 U.S. 181 (1985).

All content delivered through the Service — including but not limited to scanner results, convergence signals, trade setups, pattern matches, options-flow scores, AI-generated chart explanations, forecasts, and the daily Trade Sheet — is:

  • Impersonal. The same content is delivered to every subscriber in a tier. We do not tailor content to any individual subscriber’s financial situation, investment objectives, tax position, or risk tolerance.
  • Disinterested. ThinkTickle does not hold proprietary positions in any securities it covers, does not accept payment to feature any security, and is not compensated by issuers, broker-dealers, or market makers in connection with any signal, setup, or score surfaced through the Service.
  • Of general and regular circulation. The Service is published on a continuous, market-hours basis to all subscribers; subscription is open to the public on the same terms.

No content delivered through the Service is a “recommendation” within the meaning of the Investment Advisers Act, the Securities Exchange Act of 1934, or applicable state Blue Sky laws. Score values, grade labels (e.g., “A-Grade”), entry prices, stop levels, and target prices represent ThinkTickle’s internal characterization of pattern matches against historical market data — they are not recommendations to buy, sell, or hold any security.

5. Account Access

Access requires a Google account and approval by ThinkTickle. We may deny, suspend, or revoke access at our sole discretion. You are responsible for maintaining the security of your account.

6. Acceptable Use

You agree not to:

  • Scrape, copy, redistribute, or resell any data or content from the Service
  • Reverse engineer or attempt to access the underlying systems
  • Use the Service for any unlawful purpose
  • Share your account credentials with others
  • Use automated scripts or bots to access the Service

7. Payments and Subscriptions

Paid plans are billed in advance. All fees are non-refundable unless required by law. We reserve the right to change pricing at any time with reasonable notice. Continued use after a price change constitutes acceptance of the new pricing.

8. Auto-Trade Feature

The optional Auto-Trade feature, when explicitly enabled by a user through their connected brokerage account, routes orders to that brokerage on the user’s behalf based on signals the user has elected to act upon. By enabling Auto-Trade, the user:

  • Affirms that the decision to enable Auto-Trade is the user’s alone, made after independent evaluation of the risks of automated trading;
  • Acknowledges that ThinkTickle is not the user’s investment adviser and does not represent any signal, setup, score, or forecast as suitable for the user’s individual circumstances;
  • Accepts that every order routed by Auto-Trade is the user’s own trade and the user’s full responsibility, regardless of which ThinkTickle signal triggered the routing;
  • Configures and maintains all safety limits (per-order, daily order count, daily spend, symbol cooldown) at their discretion;
  • Bears all risk of loss arising from Auto-Trade execution, including but not limited to slippage, partial fills, order rejections, safety-halt activations, broker outages, network failures, and timing differences between signal generation and order routing.

Auto-Trade can be disabled at any time. ThinkTickle reserves the right to remove the Auto-Trade feature, modify its operation, or require re-acceptance of these terms upon material changes.

9. Intellectual Property

All content, algorithms, signals, brand names, and software are the exclusive property of ThinkTickle. “Strike Radar,” “Prism,” “My Edge,” “Genome Backtester,” and “Signal Intelligence” are proprietary features. No rights are granted to you other than the limited right to use the Service as described.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. MARKET DATA MAY BE DELAYED. WE ARE NOT LIABLE FOR DATA INACCURACIES FROM THIRD-PARTY PROVIDERS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THINKTICKLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING TRADING LOSSES, LOST PROFITS, OR LOSS OF DATA. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS.

12. Termination

We may terminate or suspend your access at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved by binding arbitration on an individual basis, not as a class action.

14. Changes to Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance. We will notify users of material changes by email.
